Tinytales – Terms of Service

1. Introduction
These Terms of Service (“Terms”) apply to all customers who purchase goods from Tinytales, an Indigenous, female-owned handmade art business in Aotearoa New Zealand (“the Business”). By placing an order, you agree to be bound by these Terms. If you do not agree, please do not place an order.

3. Orders & Acceptance
3.1 All orders placed through our website or shop are subject to acceptance by the Business.
3.2 The Business reserves the right to refuse or cancel any order at its discretion (for example, if an item is out of stock, or a pricing/description error is discovered).
4. Pricing & Payment
4.1 Prices are as listed on the website at the time you place the order, unless otherwise stated.
4.2 Payment must be made in full before goods are dispatched.
4.3 The Business accepts the payment methods displayed at checkout.
4.4 The Business reserves the right to change prices at any time (but will honour confirmed orders at the price at time of purchase).
5. Delivery & Risk
5.1 We will dispatch goods to the delivery address you provide.
5.2 Title and risk in goods pass to you once goods are dispatched.
5.3 You are responsible for any customs, duties or import taxes applicable in your country.
6. Returns & Refunds
6.1 Please also see our separate Returns & Refunds Policy.
6.2 Given the handmade nature of our goods, returns or refunds will only be offered if an item arrives with significant damage not caused by the shipping provider or by the buyer’s handling.
6.3 If a return or refund is approved, you will be responsible for return shipping costs, customs fees (if any), and any costs for a replacement item.
7. Consumer Law & Guarantees
7.1 You have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These laws cannot always be excluded, restricted or modified. For example, goods must be of acceptable quality and match description.
7.2 To the extent permitted by law, the Business’s liability is limited to the repair, replacement or refund of faulty goods, at the Business’s discretion.
8. Intellectual Property
8.1 All designs, artwork, names and branding of Tinytales are owned by the Business.
8.2 You may not copy, reproduce or use any of our designs or branding without prior written consent.
9. Privacy & Data
9.1 Your personal information will be handled in accordance with our Privacy Policy.
9.2 By placing an order, you consent to us using your contact details for order fulfilment and customer service.
10. Limitation of Liability
10.1 The Business will not be liable for any indirect, incidental or consequential loss arising from your purchase of goods.
10.2 The maximum liability of the Business for a defective product is limited to the purchase price of that product, to the extent permitted by law.
11. Changes to Terms
We may update these Terms from time to time. The updated Terms will be published on our website and become effective when posted. Your continued use of our services after that indicates your acceptance of the changed Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of New Zealand. Any dispute arising under or in connection with these Terms shall be resolved in the courts of New Zealand.
